Malcolm A. Goldstein



Malcolm A. Goldstein has practiced labor and employment for thirty years, for many of them as partner in the firm last known as O’Donnell, Schwartz, Glanstein, Rosen, DiPreta & Goldstein. After graduating from Columbia Law School, and a brief association with another firm, he became an associate at O’Donnell & Schwartz, where he began specializing in the various phases of labor and employment law, including the federal National Labor Relations Act, the federal Labor-Management Reporting and Disclosure Act, the federal Railway Labor Act, and the New York State Public Employees Fair Employment Act.

He has represented unions in the public transit, rail, airline, retail, marine, security and law enforcement, building maintenance, postal, communications and newspaper industries, as well as individuals with employment related problems. He has acted as chief spokesperson for unions in collective bargaining negotiations and has been responsible for negotiating, drafting and implementing the language of collective bargaining agreements. He has regularly presented grievances and arbitrations in both contractual and disciplinary matters.

He has acted as lead attorney in administrative litigation and has appeared before the federal National Labor Relations Board, the federal Equal Employment Opportunity Commission, the United States Department of Labor, New York’s Public Employment Relations Board, New Jersey’s Public Employment Relations Commission, the New York State Division of Human Rights, the New York City Commission on Human Rights, the federal National Mediation Board, the federal Civil Aeronautics Board, the Federal Aviation Administration, and the United States Coast Guard.

He has acted as lead attorney in court litigation in both federal and state courts, with responsibility for drafting pleadings, conducting all phases of discovery including depositions, interrogatories and production of documents, preparing motions and trying cases, both jury and non-jury. He is admitted in New York State and a variety of federal courts, including the United States Supreme Court.

He has acted as attorney for various pension and welfare funds, and participated as attorney to a major creditor in the bankruptcies of Eastern Airlines, Pan American World Airways, and Macy’s.
